1. INTRODUCTION
These Terms and Conditions ("Terms") are entered into between you ("you", "your" or "User") and Karnataka Nanbargal Benefit Association, a trust having Darpan ID KA/2024/0406994 and registered office at No. 30 Castle Street, Ashok Nagar, Bengaluru – 560025 (hereinafter referred to as "KNBA", "we", "us" or "our"), governing your registration as a member of KNBA, participation in KNBA Programmes, and use of any website, application, portal or technology platform operated by KNBA ("Platform"). By accessing, browsing, registering on, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable policies of KNBA. KNBA reserves the right to amend, modify or update these Terms at any time. Continued use of the Platform or participation in any KNBA Programme shall constitute acceptance of such revised Terms.

 

2. DEFINITIONS

i. "Agreement" means these Terms together with the Privacy Policy and other policies issued by KNBA from time to time. 

ii. "Content" means all text, graphics, photographs, videos, trademarks, logos, designs, software, data and other material available on the Platform. 

iii. "Force Majeure Event" means any event beyond the reasonable control of KNBA including natural disasters, pandemics, governmental actions, war, riots, strikes, communication failures, cyberattacks, or any other unforeseen event. 

iv. "KNBA Programmes" means any conference, business expo, networking event, workshop, seminar, webinar, training programme, youth programme, cultural programme, delegation, business meet, knowledge session, membership activity, or any other event or initiative organized, supported, sponsored or facilitated by KNBA. 

v. "Platform" means the website, mobile application, registration portal and any other digital platform operated by KNBA. 

vi. "User" means any individual, member, participant, attendee, volunteer, sponsor, exhibitor, delegate, or representative of any organization accessing or using the Platform or participating in KNBA Programmes. 

3. ELIGIBILITY
By using the Platform or registering for KNBA membership or programmes, you represent and warrant that:

a) You are at least 18 years of age.

b) You possess the legal capacity to enter into a binding agreement.

c) The information provided by you is accurate, complete and up to date.

d) You are not prohibited under any applicable law from accessing the Platform or participating in KNBA Programmes.

e) You shall promptly update KNBA regarding any material changes in information submitted by you.

 

4. MEMBERSHIP AND PROGRAMME REGISTRATION

Registration for membership and participation in KNBA Programmes is subject to:

a. Submission of complete and accurate information.

b. Satisfaction of eligibility criteria prescribed by KNBA.

c. Payment of applicable membership fees, programme fees or participation charges.

d. Approval by KNBA wherever required.

KNBA reserves the right to accept, reject, suspend or cancel any membership or programme registration without assigning reasons.

 

5. USER OBLIGATIONS

You agree to:

I. Provide accurate and complete information. 

II.Maintain confidentiality of any login credentials issued to you. 

III. Comply with all instructions, rules and guidelines issued by KNBA. 

IV. Use the Platform and participate in KNBA Programmes responsibly and lawfully. 

V. Refrain from any conduct that may harm KNBA, its members, participants, sponsors, partners or reputation. 

 

6. USER CONDUCT

You shall not:

a. Impersonate any individual or entity.

b. Submit false or misleading information.

c. Upload viruses, malware or harmful code.

d. Interfere with the operation of the Platform.

e. Collect personal information of other users without authorization.

f. Use the Platform for unlawful, fraudulent, offensive or defamatory purposes.

g. Engage in any activity that disrupts or adversely affects KNBA Programmes.

KNBA reserves the right to suspend or terminate access for any violation of these provisions.

 

7. MEMBERSHIP AND PARTICIPATION

Membership of KNBA and participation in KNBA Programmes are privileges granted by KNBA and may be suspended, restricted or terminated if:

a) Information provided by the User is inaccurate or misleading.

b) The User violates these Terms.

c) The User engages in conduct detrimental to KNBA or its objectives.

d) The User fails to comply with programme-specific requirements.

The decision of KNBA shall be final and binding.

 

8. FEES, CANCELLATION AND REFUNDS

Membership fees shall generally be non-refundable unless otherwise decided by KNBA.

Programme registration fees shall be governed by the specific cancellation and refund policy applicable to the respective programme.

KNBA may deduct administrative charges, taxes, payment gateway charges and other expenses before processing any refund.

Approved refunds shall be processed within a reasonable period through the original mode of payment.

 

9. INTELLECTUAL PROPERTY

All content, trademarks, logos, designs, publications and materials associated with KNBA are the exclusive property of KNBA or its licensors.

No User shall reproduce, distribute, modify, publish, transmit or commercially exploit any content without prior written permission from KNBA.

 

10. USE OF INFORMATION

Any information submitted by Users may be used by KNBA for:

a) Membership administration.

b) Programme management.

c) Event communications.

d) Networking initiatives.

e) Research and community development activities.

f) Compliance with applicable laws.

Such information shall be handled in accordance with KNBA's Privacy Policy.

 

11. THIRD-PARTY LINKS

The Platform may contain links to third-party websites or services.

KNBA does not endorse or assume responsibility for any third-party content, services, products or policies. Users access such third-party platforms at their own risk.

 

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, KNBA shall not be liable for any indirect, incidental, consequential, special or punitive damages arising from:

a) Use of the Platform.

b) Participation in KNBA Programmes.

c) Cancellation, postponement or modification of any programme.

d) Actions of third parties.

13. FORCE MAJEURE

KNBA shall not be liable for any delay, interruption, modification or cancellation of any KNBA Programme caused by a Force Majeure Event.

 

14. TERMINATION

KNBA reserves the right to suspend, restrict or terminate access to the Platform or participation in any KNBA Programme at its sole discretion for violation of these Terms or for any other legitimate reason.

 

15. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts at Bengaluru, Karnataka. 16. CONTACT DETAILS For any questions, concerns or grievances regarding these Terms, membership, or KNBA Programmes, you may contact KNBA through its official communication channels as notified from time to time. 17. ENTIRE AGREEMENT These Terms, together with the Privacy Policy and other policies issued by KNBA, constitute the entire agreement between KNBA and the User and supersede all prior understandings relating to the subject matter herein.
